
Dominica’s Prime Minister Roosevelt Skerrit has said that there are other machinations other than the rule of law that has motivated Attorney Cara Shillingford Marsh to challenge the Integrity Commission on a matter relating to a personal gift.
Last week, the High Court in Dominica ordered that Prime Minister Roosevelt Skerrit stop the use of his Wrangler Jeep until a legal matter is settled. The court also ruled that its registration number be suspended.
The vehicle, costing EC$194, 000.00 which was a personal gift to Skerrit by ‘Moosa Navsa’ is being challenged by attorney Cara Shillingford-Marsh.
On June 12, 2023, High Court Judge, Justice Bernie Stephenson delivered a decision in which she granted leave to Shillingford-Marsh, who is also a member of the Integrity Commission in Dominica, to file a judicial review challenging a decision of the majority members of the Commission of February 12, 2021, to allow Skerrit to keep the gift.
The claim was brought by Shillingford-Marsh against Stephenson Hyacinth in his capacity as chairman of the Integrity Commission, and Thomas Holmes in his capacity as a member of the Integrity Commission, and the Integrity Commission.
But Skerrit explained at a press conference today, that the complaint was brought against the Integrity Commission and not against him as the prime minister.
He explained that the Integrity Commission wrote him a letter informing him that he can retain the gift.
“It is clear that I have complied with the law…The facts are clear. In the interest of transparency, I declared the asset to the Integrity in 2021, whose members in their wisdom determined that it could remain in my possession”, Skerrit said
He quoted from a letter written to him by the Integrity Commission, which states in part…” Having due regard to section 35 4 (b) of the Act, in light of the fact that the gift was not trivial, but was apparently not intended to be a motive or reward for doing or abstaining from any of your official functions, you are directed to retain the gift”
Shillingford-Marsh is alleging that the Commission acted illegally, irrationally, and unreasonably when it allowed a person in public office, namely Prime Minister Skeritt, to keep the gift of the Jeep Wrangler without conducting an inquiry into the circumstances of the giving of the gift.
She argued that the Integrity Commission was required to do so under the Integrity in Public Office Act.
She further argued that the decision of the Commission was in breach of its international obligation, in that the Commission failed to give effect to Article 5 of the United Nations Convention Against Corruption and that the decision flies in the face of the provisions and in fact, amounts to the sanctioning of corruption.
She is asking that the gift be handed over to the financial secretary since the gift is property of the state and cannot be retained by the prime minister.
In the decision which came two years after the application was filed, the court granted leave to Mrs. Shillingford-Marsh to proceed with judicial review against the Integrity Commission but struck out the claim against Stephenson Hyacinth and Thomas Holmes.
Shillingford-Marsh has fourteen days from the date of the court’s decision to file her claim.
The Integrity Commission was represented by Lisa De Freitas and led by Senior Counsel Reginald Armour while Cara Shillingford-Marsh is being represented by her husband, attorney Wayne Benjamin Marsh.

So what was the reason for the gift? Why was the gift given? And why did the Integrity Commission not establish this fact as a matter of law and principle of good governance?
Is ‘Moosa Navsa’ in love with our PM? Why give a stranger such a valuable gift? What do you want or expect in retuirn? And don’t tell me you want nothing! When I give a woman a gift, I know what I want! I mean, who does that?
These are the questions that the inquiry by the Commission would elucidate. The law does not require Skerrit to provide these in his declaration.

I do appreciate you coming to clear the air during the press conference to update Dominicans on the national action plan in preparing for tropical storm Bret. However, are we to trust any correspondence from organizations you control? Mr. Skerrit it’s simple ethics as a leader or one in certain positions, refrain from accepting gifts.
I work with an investigation bureau in the United States and our investigations often take us to corner stores, restaurants and clubs where we are offered water or some beverage and the instructions are to say, no thank you. But you accept a whole car.

The fact that the Prime Minister thinks it’s OK to accept such “GIFTS” is troubling and mind boggling.
In any other properly functioning democracy the Prime Minister would be forced to resign. And that’s just the minimum. Not to mention a criminal investigation into the circumstances of the granting/receiving of the “gift.”. Because Prime Ministers don’t just get expensive “gifts” because someone likes them.

I think the question is, what ‘presents’ did those two members of the Integrity Commission receive from Skerrit in order to motivate them to write him a letter to inform that the ‘gift’ could stay in his possession. The thing about gifts is, if someone gives you such a gift, if anything comes up you’d be inclined to rule in their favor and forgo INTEGRITY. So the person cannot come and say “Sign that for me nuh, I give you a 200k gift”. Which is why I thought there was an INTEGRITY commission but not even that working.

Corruption is generally defined as the use or abuse of public office for personal gain. Was the $194,000 personal gift by “Moosa Navsa” of personal gain to the PM? In a democracy, public office holders should know that they are holding the office in trust for the people. It is not their personal property. Whether or not the integrity commission initially allowed the gift, the court has clearly noted that there is a discrepancy in the matter. Hence the suspension of the registration of the vehicle, which means this vehicle ought not be on the streets. It’s institutional corruption…. real gangsterism…!
